Terms of Service

These Terms of Service ("Terms") govern your use of the Simply Bass Productions website, accounts, store, and the BassMuse software (the "Services"). By creating an account, purchasing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be the age of majority in your jurisdiction (and at least 16) to create an account. We may suspend or terminate accounts that violate these Terms.

2. License to use BassMuse

BassMuse is licensed, not sold, under our End User License Agreement (EULA) included with the software. Subject to these Terms and the EULA, we grant you a non-exclusive, non-transferable license to install and use BassMuse on the number of machines permitted by your license (see §5). All rights not expressly granted are reserved.

3. Purchases & pricing

Purchases are processed by Paddle, our reseller and Merchant of Record; your purchase is also subject to Paddle's buyer terms. BassMuse is offered at 29.99 in each supported currency (USD, CAD, GBP, EUR). Prices are shown at checkout and may change over time; the price shown at purchase applies to that purchase. Applicable taxes are calculated and remitted by Paddle.

4. Refunds

We offer refunds within 30 days of purchase. To request a refund, contact support@simplybassproductions.com (refunds may also be handled through Paddle). Upon a refund or chargeback, the associated license is revoked and the software will cease to function as a licensed copy.

5. Activation & device limit

Each license includes one activation code that may be activated on up to three (3) machines at a time. You can view and deactivate any machine at any time from your account to free a slot. Activation binds a hashed device identifier as described in our Privacy Policy. Circumventing activation or the device limit is prohibited.

6. Acceptable use

You agree not to: (a) copy, resell, sublicense, rent, or redistribute the software or your activation code; (b) reverse engineer except as permitted by law; (c) share accounts or codes to exceed the device limit; (d) misuse, disrupt, or attempt to gain unauthorized access to the Services; or (e) use the Services unlawfully.

7. Intellectual property

The Services, including BassMuse and all related content and trademarks, are owned by Simply Bass Productions and its licensors and are protected by law. Music you create with BassMuse is yours; we claim no rights in your compositions.

8. Disclaimers

THE SERVICES AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted or error-free.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLY BASS PRODUCTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM.

10. Termination

We may suspend or terminate your access for violation of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (e.g., IP, disclaimers, liability, governing law) will survive.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. The state and federal courts located in California will have exclusive jurisdiction over disputes, subject to any mandatory consumer-protection rights in your country of residence.

12. Changes

We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use after changes means you accept the updated Terms.
